Im Europa des 21. Jahrhunderts sehen sich nationale Gesetzgeber und Rechtspraxis damit konfrontiert, dass verschiedene Rechtsmassen Geltung beanspruchen. Neben dem nationalen Recht wirkt heute vor allem das Recht der EU in vielen Bereichen vorrangig oder wird dort gesetzt, wo noch kein nationales Recht existiert. Dabei ist die Situation eine hoch dynamische, die nicht nur durch die nationale und europäische Gesetzgebung gestaltet wird, sondern auch durch die Rechtsprechung von drei Gerichtshöfen (BVerfG, EuGH und EGMR) geprägt ist. So führt die Rechtsprechung des EuGH und des EGMR zunehmend dazu, dass in vielen Bereichen das nationale Recht hinterfragt und geändert wird. Nach einem einleitenden Beitrag zur Rechtsvielfalt als historischem Phänomen wird in fünf Beiträgen das Verhältnis der verschiedenen Rechtsmassen und Institutionen zueinander aus unterschiedlichen Blickwinkeln beleuchtet. Les démons iraniens appartiennent à la catégorie générique de daēuua- (dēv en pehlevi). Or, il est paradoxal de constater que ce mot est hérité du même mot sanskrit (deva-) qui voulait originellement dire « dieu ». Le latin deus l’atteste. Comment en est-on arrivé là ?
